Acceptance of Terms

By accessing or using Kestralis ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Kestralis is a cross-platform scheduling application designed for users with special needs, particularly autism, to help create predictable routines and schedules. The App is available on Android, iOS, Web, Windows, macOS, and Linux platforms.

Open Source License

Kestralis is open-source software licensed under the MIT License. You are free to:

• Use the software for any purpose
• Modify the source code
• Distribute copies of the software
• Sublicense the software

The full MIT License text is available in the project repository. The software is provided "as is", without warranty of any kind.

User Accounts

Creating an account is optional. Accounts are only required for cloud synchronization features. If you create an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Upload malicious code or harmful content
• Impersonate others or misrepresent your affiliation
• Collect user data without consent

Subscription Terms

Kestralis offers optional premium features through subscriptions:

• Free Tier: Core scheduling features with advertisements
• Premium Tier: Ad-free experience with advanced features (if applicable)

Billing and Renewals

• Subscriptions automatically renew unless cancelled
• You will be charged through your platform's payment system (App Store, Google Play, etc.)
• Prices may change with 30 days' notice to existing subscribers
• Cancel anytime through your platform's subscription management

Refund Policy

Refunds are handled according to the policies of your platform (Apple App Store, Google Play Store, etc.). Generally:

• Refund requests within 48 hours of purchase may be granted at our discretion
• No refunds for partial subscription periods
• Contact your platform's support for refund requests

Intellectual Property

While Kestralis is open-source software, certain elements retain protection:

• Kestralis Name and Logo: Trademarked (usage guidelines in repository)
• Mulberry Symbols: Licensed from Straight Street (mulberrysymbols.org)
• Your Content: You retain ownership of schedules and data you create

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the App will be uninterrupted or error-free
• Warranties regarding data accuracy or reliability

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of data, profits, or business opportunities
• Damages exceeding the amount paid for subscriptions (if any) in the past 12 months

Indemnification

You agree to indemnify and hold harmless Kestralis, its developers, and contributors from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

Data Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the data practices described in our Privacy Policy.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Material changes will be communicated via:

• Email notification (if you have an account)
• In-app notification
• Update to the "Last updated" date above

Continued use of the App after changes constitutes acceptance of the modified Terms.

Termination

We reserve the right to suspend or terminate your access to the App at any time for:

• Violation of these Terms
• Illegal or harmful activity
• Extended periods of inactivity (cloud accounts only)

Upon termination, you may export your data. Local data remains accessible on your device.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or the App shall be resolved through:

1. Good faith negotiations between the parties
2. Mediation (if negotiations fail)
3. Binding arbitration (as a last resort)

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
